Around 2:30 p.m. on November 17, 2014, a group, including Process Servers and Trans Mountain representatives, went to Burnaby Mountain to read out the injunction and enforcement order to individuals assembled at two work locations for the field studies for the Expansion Project.

The enforcement order, issued by the BC Supreme Court on November 14, 2014, the same day it granted a request by Trans Mountain for an injunction, is to prevent protesters from obstructing work locations, and indicates individuals need to leave the site by 4:00 pm today. Part of being granted an injunction is notifying the people involved of the injunction and encroachment order. We are communicating and cooperating with the local RCMP.

Trans Mountain is hopeful individuals occupying the area will respect the order and exercise their rights to express their views in a respectful manner, while allowing our team to get the work completed.

We hope those who oppose our project respect the decision and keep peace as we resume the work required.We believe it is possible for people to protest and express themselves while we commence our work safely.

The remaining studies are an important part of providing detailed design input into what we consider is the best and least disruptive route through Burnaby and Trans Mountain is committed to completing the work. The tunnel option through Burnaby Mountain is a result of the consultation with the community, their request to see the existing pipeline rerouted and our objective to minimize disruptions to landowners, neighbours and road users.We believe tunneling is the best option and are committed to minimizing impacts to the conservation area and park uses, and mitigation and restoration.

The studies require drilling two six-inch test holes, approximately 250 metres in depth, taking core samples at the two locations. When the studies are undertaken, Trans Mountain is committed to minimizing any impacts and restoring, or compensating, for any disturbance to Burnaby Mountain. Ultimately, if the Project is approved, there will be no affect on Burnaby Mountain because the tunnel will be tens of metres below surface.
